Horman divorce focuses on murder-for-hire

Lawyers in the divorce of Kaine Horman and Terri Moulton Horman were arguing Monday morning whether evidence in an alleged murder-for-hire plot could be used in the divorce case.

PORTLAND -- Lawyers in the divorce of Kaine Horman and Terri Moulton Horman were arguing Monday morning whether evidence in an alleged murder-for-hire plot could be used in the divorce case.

Landscaper Rodolfo Sanchez-Estrada, who used to work for Terri Horman, said that she had hired him to get rid of her husband Kaine and make it look like a deadly mugging, according to a deposition released last week.

The judge Monday ruled that Terri Horman's attorneys will not be allowed to ask the landscaper any additional questions. Although he is expected to be called to testify as a witness during the hearing later this week

As for Sanchez-Estrada's deposition, Terri Horman's attorneys argued that statements made in that interview would open the door for other evidence in the criminal case to be used in the divorce. They said the deposition should not be allowed.

Kaine Horman's lawyer argued that Terri's attorneys were filing motions in the divorce case just to find out what was happening with the criminal case.

Court records also revealed Monday that Terri was called for a deposition on Dec. 4. She repeatedly asserted her Fifth Amendment rights and refused to testify about her earnings or living expenses.

Therefore her parents were asked to give a deposition, which showed they spent $250,000 to retain her attorneys and continue to support her with no expectation of repayment.

Kaine's son, Kyron Horman, disappeared from Skyline Elementary School on June 4, 2010 when he was 7 years old. Investigators said at the time that Terri was the last person to see him.

Kaine filed for divorce and a restraining order against Terri in late June, 2010.

Kaine's attorneys said Sanchez' testimony establishes a motive in Kyron's disappearance. They added that the murder-for-hire illustrates why Terri should not have visitation rights with her and Kaine's daughter, Kiara.
