ALBANY, Ore. Linn County Sheriff Tim Mueller sent a letter to Vice President Joe Biden Tuesday saying his department would not enforce any potential new gun laws that could be construed as unconstitutional.

In it, Mueller said We must not allow, nor shall we tolerate, the actions of criminals, no matter how heinous the crimes, to prompt politicians to enact laws that will infringe upon the liberties of responsible citizens who have broken no laws.

I just want honest American citizens that are law abiding, to own that type of firearm and it doesn't hurt anything in the hands of a good person, Mueller said.

There's still powerful opposition in Congress to sweeping gun regulations. So, President Obama announced 23 steps he could take through executive action alone.

Oregon Senator Ginny Burdick has been spearheading a move to pass a state bill that would ban or limit assault style rifles and limit magazines to no more than 10 rounds.

If we have a 5-shot limit for hunting big game, why on earth would want to have 100-round magazines on our streets? The only purpose of these guns is to kill people, she said.

However, Sheriff Mueller insisted he would not stand idly by, while my citizens are turned into criminals due to the unconstitutional actions of misguided politicians.
