VANCOUVER -- The mother of a Vancouver teen hit and killed by a charter bus in June is suing the driver and his employer for $5 million, according to a newspaper report.

The Oregonian reported Monday that Monserrat Hernandez Garcia, 18, had stepped into a marked crosswalk in Northwest Portland on June 8 when Charles Atarashi Start, 68, struck her with a bus.

The suit alleges that Start was overworked, claiming his employer, Seattle-based MTR Western, required him to operate the bus an excessive number of hours without proper rest, the newspaper says.

Garcia had been a student at Portland's Benson Polytechnic High School. She went to Hudson s Bay High School for her junior and senior year after her family moved to Vancouver, according to The Oregonian.
