PORTLAND A man was cited for a crash that killed a 62-year-old Portland man on April 13, but criminal charges will not be filed, police said.
Brian Francis Kenny was struck in a crosswalk in the 14200 block of Southeast Division Street by a car driven by 36-year-old Neftali Cabrera-Escobar, said Portland police Sgt. Pete Simpson.
Kenny died at the scene.
Cabrera-Escobar remained at the scene and cooperated with investigators, including taking a voluntary breath test, which showed .00 blood alcohol content, Simpson said. Investigators do not believe that vehicle speed was a factor but the vision of the driver may have been affected by the setting sun.
The Multnomah County District Attorney's Office reviewed the case and decided not to file criminal charges against Cabrera-Escobar. He was cited for not having a driver's license and for careless driving causing death to a vulnerable road user.
