McMINNVILLE, Ore. -- A federal judge says a 48-year-old man injured during a 2010 arrest can move forward with his lawsuit against law enforcement officers in Yamhill County.

The lawsuit filed by Hipolito Aranda says he suffered a broken elbow and ribs at the hands of a McMinnville Police officer and a Yamhill County sheriff's deputy.

Aranda was a passenger in a car stopped because of a suspected drunk driver. He asked to walk home as police dealt with the driver.

The lawsuit says an assisting officer searched him without cause, threw him to the ground and beat him.

Aranda was charged with resisting arrest and acquitted.

The News-Register reports Aranda is seeking $1 million in punitive damages from seven defendants. Settlement talks this month failed to reach a resolution.
