ST. HELENS, Ore. -- A man accused of killing the police chief in the northwest Oregon town Rainier has been returned to jail from the Oregon State Hospital. A trial is on hold during arguments over his mental condition and competence to stand trial.

Daniel Butts is accused of shooting Chief Ralph Painter in January 2011.

The Longview Daily News reports that doctors at the state hospital decided there was no reason to keep Butts at the secure facility and no reason to force him to take anti-psychotic medication.

Prosecutor Stephen Atchison says a third competence hearing is likely to be scheduled.

Defense psychiatrists say the 23-year-old Butts is possibly schizophrenic. He has refused medication. State doctors have testified there's no proof of mental illness. The prosecutor says Butts is faking mental problems.
