EUGENE, Ore. -- A federal judge in Eugene has thrown out the lawsuit of Fall Creek man who said an IRS agent forced him to have sex with her under threat of a penalty on his tax audit.

Judge Thomas Coffin said the sex occurred after hours, away from work and apart from her duties as a federal employee.

KVAL reports Vincent Burroughs plans to appeal.

The IRS refused to comment on the lawsuit that was filed earlier this year. The agent has resigned her position.
