RAINIER, Ore. (AP) -- The family of Rainier Police Chief Ralph Painter is frustrated that it's been two years since he was killed and no trial date has been set for the man accused of shooting him.

The Daily News reports Oregon courts are still deciding whether Daniel Armaugh Butts is competent to stand trial.

The next hearing is set for February. The Kalama, Wash., man was arrested after the shootout that killed Painter who had responded to a disturbance at a stereo shop.

Painter's widow, Amy, and about 100 other people gathered Saturday in Rainier at a candle light ceremony to remember him.
