Four Mexican officers convicted in death of Oregon tourist

CABO SAN LUCAS, Mexico -- A Mexican judge found four police officers guilty in the death of a Yoncalla tourist on vacation in a Cabo jail, according to the local Mexican newspaper.

The Tribune of Los Cabos reported one of the officers was found guilty of abuse of authority and let go after he paid a fine in connection with the August death of 38-year-old Sam Botner.

Sam Botners wife says her husband was beaten to death in a Mexican jail.

Omar Baraka, deputy justice in Baja California Sur, said that the five officers were charged last month with murder and abuse of power.

A sixth police officer was released without liability to be in the investigation.

Botner was on vacation in Mexico with his wife when he was arrested on August 27 in the parking lot of a beachfront condominium for pulling a knife during a fight with another guest.

He later died in the jail.

The state attorney general's office in Los Cabos said investigators were looking at both forensic evidence and witness accounts in an effort to piece together what happened the night Botner died.

The state attorney general would not comment on camera but said about half a dozen witnesses saw the police officers with the Oregon man.

A doctor who examined Botner when he was in custody only noted two wounds. But an autopsy conducted later showed Botner had been beaten.

The attorney general also said a toxicology report showed Botner had cocaine and meth in his bloodstream, but no alcohol.
