But they were found guilty of child neglect and criminal mistreatment.
Stephen Horvath died in September 2004 in an above-ground pool, from which some water had been drained.
The judge said yesterday that 27-year-old Crystal Delap and 54-year-old Steven Hunt are responsible for the amount of time that Stephen and his four-year-old brother, Jacob, were playing unsupervised outdoors. It was up to 30 minutes and the judge said it was "unacceptable.
Sentencing is set for September sixth to allow Stephen's father, Edward Horvath of Chiloquin, to prepare a statement.
