$10M lawsuit filed after Bend man dies during ankle surgery

BEND, Ore. -- A trial is getting underway in Bend in a $10 million medical malpractice suit.
The lawsuit was filed by the estate of a Bend man who went to St. Charles Medical Center in Bend for ankle surgery in 2006, only to die hours later.
Jury members were chosen Tuesday, and the trial is expected to last the next eight days.
The lawsuit claims negligence on the part of Dr. Anthony Hinz at St. Charles Medical Center-Bend, who they say caused Stephen Brenn to die after he went in for elective ankle surgery.
Brenn's estate settled with the hospital, so the trial going forward is solely about the doctor and nurses who administered pain medications the plaintiff believes caused Brenn's death.
Lawyers for the defense have pointed to Brenn's alleged alcohol use as a possible factor in his death.
