A circuit court judge ruled that a 1998 case violated the Oregon Constitution. The law in question declared a child born during a marriage was automatically the legal child of the husband and wife even if the man was not the biological father.
The plaintiffs were 32-year-old K.D. Parman and her partner 34-year-old Jeana Frazzini. They have two sons, Emmett, 4, and Griffin, 1.
They filed the lawsuit demanding the same legal protections because they were legally unable to marry.
The Basic Rights Oregon group said the case highlighted the need to implement Oregon’s domestic partnership law.
"We're thrilled by Judge Bloch's decision. Our family is really no different from any other family,” Parman said. “We simply want to be treated fairly under the law, for our kids to have the same opportunities as any other child to succeed and thrive, and to do everything in our power to keep them safe."
