Father of man killed by police says he will sue

CLACKAMAS -- The father of the man shot and killed by a deputy from the Clackamas Co. Sheriff’s Office on Monday plans to file a wrongful death lawsuit.

Lewis Seal said the deputy could have used non-lethal force in the deadly confrontation with his son, 24-year-old Luke Seal Monday.

“The cop makes a two-second decision and this whole family suffers and more importantly that little child suffers because he's got no daddy and he's never going to have one now,” said Lewis Seal.

Lewis said that his son was suffering from depression over a child custody dispute.

The deputy said she shot Seal as he came at her with two knives and later that morning, the medical examiner said he determined that was the suspect's way of intentionally committing suicide.

Detective Jim Strovink with the Clackamas County Sheriff's Office said the deputy did not have enough time to use a tazer.

“You have an individual that’s traveling at you rapidly and he’s armed with two knives. That’s enough to kill you and you must respond with lethal force,” he said.

Seal, of Southeast Portland, was pronounced dead at an area hospital about two hours after the shooting. Medical Examiner Dr. Larry Lewman said Seal suffered deadly bullet wounds to his chest and abdomen.

The deputy, who was not hurt, said she ordered Seal to stop when he threatened her, but he ignored the warnings and she was forced to shoot at him in self-defense.

The suspect “was advancing rapidly” toward the deputy and “posturing himself in a life-threatening fashion,” explained Detective Jim Strovink, a spokesman for the Clackamas County Sheriff's Office.

A team of investigators was on the scene gathering evidence and taking measurements for most of the morning.

Investigators said the incident all started around 3:30 a.m., when someone called 9-1-1 from a pay phone to report a suspicious "wierdo" lurking in the shadows of a strip mall near the intersection of SE 82nd Dr. and Highway 212 in Clackamas.

Seal was taken to an area hospital where he was pronounced dead about two hours later. Police were looking into the possibility that he may have made the mysterious 9-1-1 call that drew the deputy to the Greenhouse Square Shopping Center.

Strovink said the officer's name would probably be released in a couple days. The 19-year veteran was put on administrative leave, which is the normal procedure during this type of investigation.
