BEAVERTON -- Investigators have concluded that a deadly collision between a 15-year-old bicyclist and a bus in Beaverton last February was caused by the young cyclist.

According to a police report released Monday, Austin Miller crossed against a red light and collided with the bus near the intersection of SW Farmington Road and SW Murray Boulevard on February 11th.

The report states, "This crash occurred because Austin Miller failed to stop his bike prior to entering the bike path on westbound Farmington Road..." and the accident was “unavoidable” on the part of the bus driver.

At about 4:41 p.m. on February 11th, a TriMet bus operated by Sandy Mann was westbound on Farmington Rd. and entered the intersection at Murray Blvd. with a green traffic signal, according to the report.

At the same time, Miller was southbound on his bike along SW Murray Blvd., approaching SW Farmington Rd.

Miller was on the west side of SW Murray, on an off-road mixed use path, serving both bicyclists and pedestrians.

“The investigation showed the bicyclist was southbound … and came off the pathway to make a right turn onto SW Farmington and entered the westbound bike lane against a pedestrian traffic signal,” the report states.

The actual collision between the bus and the bicyclist occurred west of the intersection on the north side of SW Farmington, investigators said.

“Based on examination of all physical evidence and witness statements, investigators concluded the collision was unavoidable on the part of Ms. Mann and no citations were issued,” according to the report.

The investigation was submitted to the Washington County District Attorney's Office for review for potential criminal prosecution and was declined.

Miller's mother told KGW she disagree's with the report and is very disappointed with the outcome.

Miller’s parents have said their son was a dedicated bicycle commuter who stressed safety. He always wore a helmet, and he changed his route to school after his mother voiced concerns about heavy traffic.
