Family sues over deadly Gearhart plane crash

PORTLAND, Ore. -- The family of a Beaverton girl has filed a lawsuit for damages in a plane crash that killed three children as well as the plane’s pilot and passenger last August.

The plane crashed into a home in the coastal community of Gearhart on Aug. 4, 2008, killing 10-year-old Julia Reimann, two of her cousins, pilot Jason Ketcheson and Frank Toohey, his 58-year-old passenger.

The lawsuit claims Ketcheson was flying under the influence of a sleeping aid, Ambien, when he crashed the plane. It also alleges he was negligent in his preparation for the flight and violating federally-mandated flight rule conditions. More: Read the lawsuit (PDF)

The pilot’s estate administrator and the owners of the rental home that the Reimann family resided in were named in the suit.

Wyndham Worldwide Corp. and its subsidiaries were named as Ketcheson's employers at the time of the crash.

Greg and Nancy Marshall, residents of Multnomah County, were named as the vacation home owners and sued for failing to provide an emergency escape route.

Specifically, the lawsuit claims the Marshalls were "negligent in failing to ensure that all bedroom and second floor windows opened."

The lawsuit seeks damages, including pain, suffering and health care expenses, for the 10-year-old girl’s death as well as injuries suffered by her mother, Ruth Reimann, who was badly burned when the house they were vacationing in exploded in flames after the plane crash.

Ruth Reimann’s other daughter and son also suffered extensive burn injuries in the explosion.
