Baby found at Portland nursing home

A newborn baby girl with it's umbilical cord still attached was found abandoned on the doorstep of a Nursing home in Northeast Portland Sunday morning.
Sergeant Brian Schmautz with the Portland Police said an employee of the Rose City Nursing home at 34 NE 20th discovered baby 'Delta Doe' when reporting to work shortly before 5:00 a.m. Sunday.
Schmautz said the baby was found wrapped up but it's umbilical cord was still attached.
Emergency crews responded to the scene and transported the baby to Legacy Emanuel Hospital, where the baby was in fair condition Monday.

Schmautz said the child was reportedly suffering from hypothermia but was otherwise doing well.
As far as when the child was left at the nursing home, sergeant Schmautz could only say that it was sometime between 10:00 p.m. Saturday and 4:45 a.m. Sunday.
Oregon has a no-questions-asked law that allows a parent to leave a newborn baby at a medical facility within 30 days of it's birth.
The Oregon Department of Human services website states, "To avoid the tragedy of an abandoned baby, Oregon created a law that allows a distressed parent to give up a baby safely, legally, and confidentially. This law allows a birth parent to leave a newborn infant at a hospital, doctor's office, birthing clinic, police station, fire department, or sheriff office."
The DHS website does outline a few provisions that must be met for the parent to avoid criminal charges. The law states:
There will be no legal consequences for making this choice as long as the baby:
- is 30 days old or younger
- is handed to a person at one of the above safe places, and
- shows no signs of abuse

Sergeant Schmautz said the big question for investigators will be determining if the Nursing home qualifies as a medical facility.
A juvenile court ordered the baby into the custody of the state on Monday. She will eventually be put into foster care, then put up for adoption.
