Homeowner shoots suspected thief
12:38 PM PDT on Friday, June 27, 2008
A man shot a suspected thief in northeast Portland late Thursday night, police said.
Homeowner Mike Francis told KGW he only fired his gun after the man who was trying to steal his RV came after him.
The incident happened in the 1400 block of Northeast Marine Drive.
Francis said his wife heard someone start up the RV in the driveway while he was inside watching television.
"I walked back over by the house and just stood in the shadows and waited for a few minutes and then somebody came out. Two people came out -- a man and a woman,” Francis said.
He told KGW he warned them he had a gun and had called police and ordered them to stay where they were, but the man didn't listen and started coming at him.
"‘If you don't stay where you are, I'm going to shoot you,’ and he just kept coming at me and I shot him,” Francis said. "It was frightening. That's about all I can say."
According to police, Francis first fired one round into the air as he attempted to stop the suspects. He then fired a second round at one of the suspects as they approached him in a threatening manner.
The male suspect, 37-year-old Gary Miller, was taken to the hospital with gunshot wounds to the hand. He was later arrested. The woman, 21-year-old Delisa Petersen, was also arrested. Both were charged with unauthorized use of a motor vehicle.
Police said that since Francis was being threatened, it doesn't appear he broke any law.
"You can't use a gun if someone takes your lawn ornament or a lawn mower and is going the opposite way, but if someone's threatening you or you feel threatened, than you can use a gun,” said Portland Police Sgt. Brian Schmautz.
Francis said he still can't believe what happened.
"I'm still kind of reeling from it all,” he said.
