LINCOLN CITY, Ore. – A Grand Ronde woman has been indicted for driving under the influence, reckless driving, reckless endangering and assault after crashing her SUV into a creek with her three young children inside last month.

Oregon State Trooper Bryan Fitch said 26-year-old Amber Lee Gandy was arrested Thursday and taken to the Lincoln County Jail.

Gandy, along with her infant son, two-year-old daughter, and three-year-old son were pulled from the SUV by Good Samaritans after she crashed into a creek outside Lincoln City.

Gandy's 6-month-old son, Kameron, was not breathing when he was pulled out of the SUV in his car-seat but paramedics were able to revive him.  He was rushed to Samaritan North Lincoln Hospital in Lincoln City along with Amber, two-year-old Kylie and three-year-old Austin Gandy.

The crash was reported by a man and wife who live on Widow Creek Road and spotted the crash just after it occurred. They said the Ford Explorer was upside down in the creek, half-submerged in rushing water, according to Mark Meister, with the Lincoln County Sheriff's Office.

While his wife called 9-1-1, the man, who wished to remain anonymous, ran into the rushing water and was able to get Kylie and Austin out of their car-seats and safely to shore. Then, he helped Amber get out of the car but it wasn’t until after she reached the shore that everyone realized the infant was still in the SUV.

“He then learned that there was a 6-month old still trapped in a car-seat located in the front, passenger seat of the vehicle.  He was able to get Kameron from the vehicle and to the shore, but Kameron was not breathing and did not have a pulse,” Meister said.

Kameron was later transferred from North Lincoln Hospital to Doernbecher Children’s Hospital in a LifeFlight helicopter in critical condition.  Kylie, Austin, and Amber were treated and released in Lincoln City.

“Evidence revealed that Amber Gandy was under the influence of intoxicants and that alcohol was a contributing factor of the traffic crash,” Meister said.

I am disgusted that any mom would drive drunk with children in the car. She doesn't deserve to have them.

kklockner said on November 19, 2009 at 9:41 AM

OMG! She doesn't deserve to get those children back!

sallee said on November 19, 2009 at 10:29 AM

I just can't believe it.....absolutely amazing! Prayers for the kids, especially the little guy. I just don't understand people sometimes.

The guy who rescued them is a hero!

vancouvermom said on November 19, 2009 at 12:08 PM

Wow this could have been such a tragic story if not for that amazing man jumping in and saving them all.

smarie said on November 19, 2009 at 12:11 PM

Pathetic that she has 3 children. How many other times has she done this and been lucky that nothing this tragic occured. Those poor innocent children need a new parent!

Everyone makes mistakes, but NOT involving danger to children. It makes me wonder why she was drunk with her children in the car... did she take them out to party?? Absolutely disgusting... Get a Babysitter!

I hope she learns a lesson from this and seeks the help she needs. If she can change her life and become a better influence on her children maybe she will get them back. I don't see how she will come away from this with custody. But my real question, where is the father/s? So many grown up boys these days and not enough men.

Hang Her... Hang her on attempted murder charges, not only for putting her kids life on the line, but the other people on the road as well...

Amber will have a constant reminder of this incident, in the form of her little son, Kameron, who no doubt has suffered some degree of brain damage from this accident. Thank goodness one of the tots had the presence of mind to tell the rescuer that there was a baby in the submerged vehicle. The mom obviously was unaware...

She's 25 and has three babies. 25!!! We ALL make terrible mistakes. The question is, will she learn from this? She will undoubtably face charges and her children will be taken away. That's the ultimate price she will pay. So, she will have two choices. Succumb to the disease of alcoholism or fight, fight, fight! I personally hope she chooses to fight the disease, change her ways, and one day rise above the guilt and make her life better. We should not judge others, lest we be judged.

this woman, My sister saw her right before this happened and she told me that before all this she left her kids in the car while she was in the store now that is so pathedic. this is not a good woman to have children

Drinking and Driving should be Attempted Murder. You are acting with depraved indifference to human life. Loss of Parental Rights and a long jail sentence are in order.

I'm with swtp2nia on this one. Alcoholism doesn't care about kids, neither does drug addiction. This intervention, expensive as it was, could be the wake up call she needs to begin making changes. I don't doubt the children will be in foster care until Amber can get some treatment, make some changes, and sustain those changes.

WHY is it SO EASY to get drunk and drive in this nation still?

Loss of Parental Rights and a long jail sentence are in order. I don't know about all that, as alcoholism is clearly a disease, and we have enough mental patients in the wrong sort of "lockups" already. Let's build more medical and treatement centers, and get the addicts out of the prisons and jails, freeing up SO much money now wasted on LE/corruption (which are too often the same).

How come the 12-Step Religious Cult's "Higher Power" is never around to stop the drunks BEFORE they get in the car......NEVER!

lovesthebeach said on December 18, 2009 at 1:24 PM

rejco 100 - because she had the "free will" to go out and get drunk. That's why!

shallowend said on December 18, 2009 at 3:51 PM

van native: I have very little sympathy for a "disease" that is voluntarily contracted. My uncle was a major league lush (hospitalized with alcohol poisoning 8 times!), went into treatment at least 10 times (8 occasions to get a DWI or DUII off his record), and still died a drunk. No one ever forced him to take that first drink. And no one ever made him continue the behavior. He never killed anyone only because he lived in Manhattan and never had a car, never drove. I agree it is an illness, but if you WANT to get better, you can. I do not accept voluntary "disease" as any kind of mitigation for a crime.

cybersleuth said on December 18, 2009 at 4:21 PM

Hopefully the Tillamook county DHS office will put those kids into foster care or relative foster care. The mother is a time bomb waiting to self-destruct. Gawd, try some birth control, dumb chick.

lalalu said on December 18, 2009 at 5:19 PM

I have to concur with "Shallowend". I have no sympathy for long-time users. My sister is one and has driven drunk so many times and with her son in the car. She is 59 now and her life is reduced to nothing! I have finally given up on her and do not take her calls anymore. I am done with whatever enabling I did by just being in her life and "helping" her. Just a waste of too many years and tears. I hope the state takes the children away for their own safety. They are all that matters in this case.

speakthetruth said on December 19, 2009 at 12:05 AM

Put the kids under State protection, and remove her ovaries permanently.

last_girlscout said on December 19, 2009 at 7:46 AM

interesting - the usual rednecks here don't seem half as upset as usual... but then again, she's just a white native girl... can we send all rednecks back to where they came from and then build a fence to keep them out? Oregon would have a population of about 1200

spewie said on December 19, 2009 at 8:26 AM

You're 100% correct girlscout. But the remaining 1200 would all be 'rugged' females who drive tow trucks for a living... Si Se Puede!

spewie said on December 19, 2009 at 8:28 AM

Shallow, he got his DWI's on a bicycle??? Si Se Puede!
